1. The Artwork: The Art Collector, ________ is commissioning the Artist, Josh Reed to paint an original oil painting on canvas.
2. The Concept: The Artist will paint an original painting on canvas. Torn canvas painting concepts are to be agreed upon by Artist and Art Collector.
3. Payment Amount: Painting size will be mutually determined by the Artist and the Art Collector. The Art Collector will pay the shipping costs of artwork.
4. Payment Schedule: Non-refundable 50% deposits are required before commencement of artwork. Final payment is due once artwork is complete before shipment, if applicable. If the Artist is unable to complete the commission for any reason, the Art Collector will receive a full refund.
5. Copyright: The Artist retains the copyright to all works commissioned by the Art Collector that were created by the Artist, including all reproduction rights and the right to claim statutory copyright. No artwork may be reproduced or altered without the written consent of the Artist.
6. Right of Refusal: In the event that the Art Collector does not wish to purchase the commissioned artwork, the Art Collector may refuse. In that case, the Artist will retain the refused artwork and the non-refundable deposit. This is free of any claims or interests of the Art Collector and the Art Collector will not owe any additional fees to the Artist.
